The Bombay High Court expressed strong displeasure with the Maharashtra Food and Drug Administration (FDA)’s handling of the situation. The court stated that officials neither properly understand court orders nor thoroughly study relevant laws and regulations. The court questioned the officials’ attitude, stating that taking action without a proper legal basis is unjustified.
The case involves the Mumbai Cricket Association (MCA). The MCA had filed a petition in the Bombay High Court challenging the FDA’s action. On August 21st, the FDA suspended the food licenses of five restaurant outlets affiliated with the MCA after a preliminary investigation.
A new report presented during the hearing revealed that all five restaurants now comply with approximately 88% of food safety standards. Based on this, the High Court’s division bench allowed the five restaurants to reopen and withdrew the license suspension order.
The court stated that while ensuring food safety and hygiene is essential, administrative action must be appropriate and proportionate. Establishments should be given the opportunity to improve and comply with regulations, rather than being immediately shut down.
The High Court also commented on the actions of FDA officials. According to the court, the relevant officer issued the order without providing a valid reason and failed to conduct the legal analysis required under the Food Safety Act. The court emphasized the need for officials to understand the rules and regulations before taking action.
During the hearing, the court recommended that the FDA consider a policy. It stated that large restaurants should have their own websites where customers can share their opinions regarding hygiene, food quality, and taste. This would provide customers with information and allow establishments to improve their services.
The FDA told the court that the restaurant was operated by M/s Shirke Infrastructure, while the food license was in the name of the Mumbai Cricket Association. The FDA informed the court that it would issue a new notice to the MCA and hear its side of the contract with Shirke Infrastructure. A new order with reasons would then be issued in the matter.
The High Court stated that the continued suspension of the restaurants’ licenses was not justified when they now complied with prescribed food safety standards. Following this, the suspension orders were withdrawn and the five restaurants were allowed to reopen.
The Maharashtra FDA has been in the news for its strict enforcement actions for some time now. Since the new FDA Commissioner, Tukaram Mundhe, took office, the department has conducted large-scale inspections and raids. The department’s actions have included suspending the licenses of several food establishments and taking action against violations of food safety regulations.
The FDA’s action has even impacted the High Court canteen. Furthermore, the FDA has been in the news after Bollywood actors Shah Rukh Khan, Ajay Devgan, and Tiger Shroff were issued notices regarding their Vimal advertisements. Social media has generated a variety of reactions regarding these actors.
